Terms and Conditions
The webshop fodere.ee (hereinafter the Webshop) is owned by FODERE OÜ (registry code 16483880), located at Marati 5a, Tallinn 11712.
- Validity of sales contract, product and price information
- The conditions of sale apply to purchases of products from the Webshop.
- The prices of the products sold in the Webshop are indicated with the products and include VAT. The delivary fee is added to the price.
- The delivery fee depends on the location of the purchaser and method of delivery. The delivery fee will be shown to the buyer when placing the order.
- All prices are in Euros (€).
- Product information is available in the Webshop directly at the item.
- Ordering
- You have to add the desired products to the shopping cart. To place an order, fill in the required fields and choose the appropriate delivery method. The amount of the fee will then be displayed on the screen, which can be paid by bank link or other payment method.
- The contract of sale shall enter into force from the date of receipt of the amount due into the bank account of the Webshop.
- If the ordered products cannot be delivered due to the end of the products or for any other reason, the purchaser will be informed as soon as possible and the money paid (including the delivery fee) will be refunded immediately, but no later than within 14 days of receiving the notification.
- Orders placed on the Webshop will be processed within three (3) working days (excluding weekend and holidays) after receiving your order.
- Shipping
- In the case of a "pick-up" delivery order, the delivery time must be agreed in advance by e-mail.
- The products are shipped to the following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Great Britain, Greece, Hungary, Iceland, Ireland, Italy, Spain, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia and Switzerland.
For delivery to other countries, contact info@fodere.ee to arrange shipping. - The cost of shipping the products is covered by the purchaser and the corresponding price information is displayed next to the delivery method.
- Delivery within Estonia generally arrive at the destination specified by the purchaser within 3-7 working days from the entry into force of the contract of sale. All delivery outside of Estonia is within 30 calendar days. In exceptional cases, the Webshop have the right to deliver the goods within 45 calendar days.
- In the case of a "pick-up" delivery order, the delivery time must be agreed in advance by e-mail.
- Right of withdrawal
- After receiving the order, the purchaser has the right to withdraw from the contract concluded in the Webshop within 14 days.
- The right of withdrawal does not apply if the purchaser is a legal entity.
- In order to exercise the 14-day right of withdrawal, the ordered products may not be used in any way other than that necessary to ascertain the nature, characteristics and functioning of the products as permitted by the physical store test.
- If the products have been used for any purpose other than that necessary to ascertain the nature, characteristics and functioning of the products, or if there are any signs of use or wear, the Webshop has the right to refuse the return.
- In order to return the products, the purchaser must submit a withdrawal form and send it to the email address info@fodere.ee no later than 14 days after receipt of the products.
- The costs of returning the products shall be covered by the purchaser, unless the reason for the return is the fact that the product to be returned does not correspond to the order (e.g. a wrong or defective product).
- The purchaser must return the products within 14 days of submitting the application or provide proof that they handed over the products to the carrier within the aforementioned period.
- Upon receipt of the products to be returned, the Webshop shall refund the purchaser any fees received from the purchaser under the contract of sale immediately, but no later than 14 days after receipt of the application for withdrawal.
- The online store may refuse to refund until the products that is the subject of the contract has been returned or the purchaser has provide proof of return, whichever is earlier.
- If the purchaser has explicitly opted for a method of delivery other than the cheapest standard delivery method offered by the Webshop, the Webshop is not required to reimburse the purchaser for any cost exceeding the standard delivery method.
- The Webshop has the right to withdraw from the sale and to reclaim the products from the purchaser if the price of the goods in the Webshop is mistakenly marked below the market price.
- Right to file a claim
- The products on the Webshop include handmade products and pre-owned (second-hand) products. While the Webshop will endeavour to accurately describe the condition of all products on the online store, the purchaser should be aware that the products may contain wear and tear and individual differences. The Webshop is not liable for any defects or differences that are noted in the Webshop at the time the contract was concluded.
- The Webshop shall be liable for any lack of conformity or defect in the products sold to the purchaser, which existed at the time of delivery of the item, and which occurs within two (2) years of delivery of the products to the purchaser. Within the first six months of delivery of the item to the purchaser, the defect is presumed to have existed at the time of delivery. It is the Webshop's responsibility to rebut this assumption. The purchaser is obliged to contact the Webshop within two months at the latest, by sending an e-mail to info@fodere.ee. The Webshop is not liable for any defects that have arisen after delivery of the products to the buyer which are caused by inadequate storing conditions, unpurposeful use of the products or action/inaction by the purchaser.
- If any products purchased from the Webshop have defects for which the Webshop is liable, the Webshop will replace the defective products. If the products cannot be replaced, the Webshop will refund to the purchaser all the fees associated with the contract of sale.
- The Webshop will respond to the purchaser’s complaint in writing or in a format that can be reproduced in writing within 15 days.
- Direct marketing and processing of personal data
- The Webshop will only use the personal information entered by a purchaser (including name, phone number, address, e-mail and bank details) to process the order and send the products to the purchaser. The Webshop will transmit personal information to the transport service provider in order to deliver the products.
- Solving arguments
- If the Purchaser has any claims regarding the Webshop, they should be emailed to info@fodere.ee.
- If the purchaser and the Webshop cannot settle the dispute by agreement, the purchaser may refer the matter to the Consumer Dispute Committee. The Consumer Dispute Committee is competent to resolve any disputes arising from the contract between the purchaser and the Webshop. The Committee review of the purhcaser's complaint is free of charge. The purchaser can turn to the European Union Consumer Dispute Resolution Platform.
